Terms of Service
Overview
HAPulse is operated by Julian Spillner ("we", "us", "our"). We offer this website together with the HAPulse dashboard for Home Assistant — including the free, open-source self-hosted edition and the paid hosted subscription — to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.
By visiting our site and/or subscribing to the hosted service, you engage in our "Service" and agree to be bound by these Terms of Service ("Terms"), including the additional terms and policies referenced herein. These Terms apply to all users of the site.
Section 1 — Eligibility
By agreeing to these Terms, you represent that you are at least the age of majority in your place of residence. You may not use the Service for any illegal or unauthorized purpose, nor may you, in using the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms, viruses, or any code of a destructive nature. A breach or violation of any of these Terms may result in immediate termination of your Service.
Section 2 — The Service
HAPulse provides a web-based dashboard interface for Home Assistant. The dashboard connects from your browser directly to your own Home Assistant instance. Your Home Assistant URL and access token are processed in your browser and, on the hosted plan, are never transmitted to or stored on our servers. The Service depends on your own Home Assistant instance, which we neither operate nor control.
Section 3 — Subscriptions, Billing & Cancellation
The hosted plan is offered as a recurring monthly subscription at €4.99/month (plus any applicable taxes). Payments are processed securely through Stripe; we do not store your full payment-card details. Your subscription renews automatically each month until cancelled.
You may cancel at any time from your account's billing portal. When you cancel, your subscription remains active until the end of the current paid period, after which it ends and access to the hosted dashboard stops. Except where required by mandatory law, payments for the current period are non-refundable. Statutory rights of withdrawal that may apply to consumers in the EU remain unaffected. The free, self-hosted edition is provided under its open-source license and is not subject to these billing terms.
Section 4 — Modifications to the Service and Prices
Prices for the Service are subject to change; we will give reasonable notice of any change to your recurring price before it takes effect. We reserve the right at any time to modify or discontinue the Service (or any part of it) with reasonable notice.
Section 5 — Accounts and Accurate Information
To use the hosted service you must create an account with a valid email address. You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide current, complete, and accurate account and billing information.
Section 6 — Third-Party Services
The Service relies on third-party providers, including Stripe (payments) and Supabase (authentication and data storage), and connects to your own Home Assistant instance. Your use of those services may be subject to their respective terms. We provide access to such tools "as is" and "as available" without warranties of any kind.
Section 7 — Third-Party Links
The Service may include links to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating their content and do not warrant and will not have any liability for any third-party materials or websites.
Section 8 — Feedback and Submissions
If you send us creative ideas, suggestions, proposals, or other materials — whether at our request or not — you agree that we may, at any time and without restriction, use, edit, copy, publish, and otherwise act on them without obligation to you.
Section 9 — Personal Information
Your submission of personal information through the Service is governed by our Privacy Policy.
Section 10 — Prohibited Uses
You are prohibited from using the Service or its content: for any unlawful purpose; to solicit others to perform unlawful acts; to violate any applicable regulations, rules, or laws; to attempt to gain unauthorized access to any systems; to upload or transmit malicious code; or to interfere with or circumvent the security features of the Service.
Section 11 — Disclaimer of Warranties; Limitation of Liability
We do not guarantee, represent, or warrant that your use of the Service will be uninterrupted, timely, secure, or error-free. The Service is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable mandatory law.
Section 12 — Indemnification
You agree to indemnify, defend, and hold harmless HAPulse and its operator, Julian Spillner, from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.
Section 13 — Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.
Section 14 — Termination
The obligations and liabilities of the parties incurred prior to the termination date survive the termination of this agreement for all purposes. These Terms are effective unless and until terminated by either you or us.
Section 15 — Governing Law & Entire Agreement
These Terms are governed by the laws of Germany, without regard to conflict-of-law rules and without prejudice to any mandatory consumer protections of your country of residence. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
